Overview

This website is operated by Neoprene Snob ("we," "us," "our"), owned by Dustin Bozarth and based in Texas. By visiting neoprenesnob.com or buying from us, you agree to these Terms of Service ("Terms"), along with our Refund Policy, Shipping Policy, and Privacy Policy, which are part of these Terms. If you don't agree, please don't use the site. Our store is hosted on Shopify Inc., which provides the e-commerce platform we use to sell to you.

1. Using our store

By agreeing to these Terms, you confirm that you are at least the age of majority where you live, or that you have your parent or guardian's permission to use the site. You may not use our products or site for any illegal or unauthorized purpose, or in violation of any law. Breaking any of these Terms may result in immediate termination of your access to the site.

2. General conditions

We may refuse service to anyone for any reason at any time. Your content (not including payment card information) may be transferred unencrypted across networks and adapted to technical requirements; payment card information is always encrypted in transit. You agree not to copy, sell, resell, or exploit any part of the site, its designs, or its content without our written permission.

3. Accuracy of information

We work to keep the site accurate, but we aren't responsible if information here is incomplete, out of date, or not perfectly precise. Product mockups are illustrations; colors and print placement on screen may differ slightly from the finished product. We may change site content at any time without notice, and we aren't obligated to update it.

4. Products, prices, and changes to the service

Every product is printed to order by our production partner after you buy it. Prices and products may change without notice. We may modify, suspend, or discontinue any product or part of the site at any time, and we're not liable to you or anyone else for doing so. We may limit sales of any product to any person or region. We currently sell and ship to the United States only (including AK, HI, PR, and APO/FPO addresses).

5. Orders, billing, and account information

We may refuse or cancel any order, including orders that appear to be placed by dealers, resellers, or distributors, or that look fraudulent. If we change or cancel an order, we'll try to notify you using the email or billing information you gave us, and we'll refund any amount charged. You agree to provide current, complete, and accurate purchase and account information so we can complete your order and contact you. Because items are made to order, cancellations are only possible as described in our Refund Policy.

6. Shipping and delivery

Production and delivery times, and shipping costs, are described in our Shipping Policy. Delivery estimates are estimates, not guarantees. Title and risk of loss pass to you when the order is handed to the carrier, though we'll still help as described in our Refund Policy if a package is lost or damaged.

7. Returns and refunds

Because everything is printed to order, we don't accept returns or exchanges on items that arrive correct and undamaged. If an item arrives misprinted, defective, damaged, or wrong, we'll replace or refund it as described in our Refund Policy.

8. Third-party tools and links

We may give you access to third-party tools or links that we don't monitor or control. They're provided "as is," without any warranty or endorsement, and your use of them is at your own risk and subject to the third party's terms. We aren't responsible for third-party websites, products, or services.

9. Comments, feedback, and other submissions

If you send us ideas, suggestions, reviews, or other material, you agree we may use, edit, copy, and publish it in any medium without compensation or obligation to you. You agree your submissions won't violate anyone's rights or contain unlawful, abusive, or obscene material, malware, or false identity information.

10. Personal information

Your submission of personal information through the store is governed by our Privacy Policy.

11. Errors and omissions

The site may occasionally contain typos, inaccuracies, or omissions involving product descriptions, pricing, promotions, shipping charges, or availability. We may correct errors, change information, or cancel orders if information is inaccurate at any time without prior notice, including after you've submitted your order.

12. Prohibited uses

You may not use the site or its content: for any unlawful purpose; to solicit others to break the law; to infringe our or anyone else's intellectual property; to harass, abuse, defame, or discriminate; to submit false or misleading information; to upload viruses or malicious code; to collect others' personal information; to spam, phish, scrape, or crawl; or to interfere with the site's security. We may terminate your use of the site for violating any of these prohibitions.

13. Intellectual property

The Neoprene Snob name, logo, phrases, designs, and site content belong to us or our licensors and are protected by law. Buying a product gives you the product, not the rights to the design.

14. Disclaimer of warranties; limitation of liability

We don't guarantee that the site will be uninterrupted, timely, secure, or error-free. Except as expressly stated by us or required by law, the site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement. To the fullest extent permitted by law, Neoprene Snob and its owner, affiliates, partners, and service providers are not liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the site or any product. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.

15. Indemnification

You agree to indemnify and hold harmless Neoprene Snob and its owner, affiliates, partners, and service providers from any claim or demand, including reasonable attorneys' fees, made by a third party because of your breach of these Terms or your violation of any law or the rights of a third party.

16. Severability

If any part of these Terms is found unlawful, void, or unenforceable, that part will be enforced to the fullest extent permitted, and the rest of the Terms will remain in effect.

17. Termination

These Terms apply until terminated by you or us. You can terminate them by no longer using the site. We may terminate them at any time if we believe you have failed to comply, and you remain responsible for amounts owed up to that date.

18. Entire agreement

These Terms and any policies or rules we post on the site are the entire agreement between you and us about your use of the site, and they replace any earlier agreements. Our failure to enforce any right or provision isn't a waiver of it.

19. Governing law

These Terms and any separate agreements under which we provide you products or services are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. You agree that any dispute will be resolved in the state or federal courts located in Travis County, Texas, unless applicable law requires otherwise.

20. Changes to these Terms

We may update these Terms at any time by posting changes on this page. The latest version is always here. Continuing to use the site after changes are posted means you accept them.
